Terms of Service
Last updated: October 5, 2026
About these Terms
These Terms of Service (“Terms”) are an agreement between you and Growth Data, 14 Meeshea Street, Race Course, Accra, Ghana (“we”, “us”), which operates Customs Declare at customsdeclare.com. If you create or use an account for a company, “you” includes that company, and you confirm you are authorized to accept these Terms on its behalf.
You must accept these Terms and our Privacy Policy to create an account. If you don’t accept them, you can’t create an account or use the platform.
The service
Customs Declare lets you upload trade documents (invoices, packing lists) and generates customs declarations from them, using automated extraction and validation. Documents can reach the platform through the dashboard, the API, or a mailbox you connect, and results can be passed on to accounting systems or webhook endpoints you configure. Every declaration is built to help you complete a document in minutes, not hours -- but no declaration is ever filed automatically, no matter how confident the automated classification is. Every declaration is presented to you for human review and explicit approval before it is finalized, and this step applies to every workspace member, including workspace admins -- there is no role or confidence level that skips it.
Your responsibility for every declaration
By accepting these Terms, you confirm that critically reviewing every detail of a document -- HS codes, duty and tax figures, party and shipment information, and every other declared field -- before approving and filing it with any customs authority is your responsibility, not ours. The platform surfaces warnings and confidence indicators to help you review efficiently, but it does not replace your own compliance review, and using it does not transfer that responsibility to us.
Accounts and workspaces
- Give accurate information when you sign up and keep your credentials secure. A signup must be completed in the same browser it was started in.
- Workspace admins decide who has access and with which role, and are responsible for what members and service accounts do in their workspace.
- Tell us promptly at support@customsdeclare.com if you believe your account has been compromised.
Plans, billing and payment
- Current prices and plan details are shown on our Pricing page. Payments are processed by Paystack.
- Prices are in US dollars, but Paystack processes every charge in Ghana cedis (GHS). Before you pay, Billing shows the exact cedi amount, converted from the dollar price at the current exchange rate. Paystack’s transaction fee is added by Paystack at checkout and is paid by you, and your card issuer may apply its own conversion. A paid plan covers one month and does not renew automatically; we email a reminder before it ends and you renew by paying again. Your plan and balance are always tracked in US dollars.
- Workspaces whose sign-up location resolves to an African Union member state automatically receive regional pricing. That country is determined from the IP address used to sign up.
- Subscription plans bill on a monthly cycle anchored to the date your workspace was created, not the calendar month.
- Pay-Per-Use workspaces are charged per document from a prepaid balance. Processing requires a prepaid balance of at least US$10.
- New workspaces get one document processed free of charge before billing applies.
- Once a subscription plan’s included monthly quota is used up, document processing is paused until you either enable per-additional-document billing from Billing (billed at that plan’s overage rate) or your next billing period begins.
- A document becomes billable as soon as AI processing has been performed on it, even if you later reject the result. A document that fails before any AI processing cost is incurred is not billed, and any Pay-Per-Use charge for it is returned to your balance automatically.
Refunds aren’t automatic. If you believe a charge is a billing error or you have a dispute, contact support@customsdeclare.com; refunds for partially-used periods or disputed charges are reviewed and granted at our discretion, case by case.
Your content
You keep all rights to the documents and data you upload. You allow us to store and process them -- including through the subprocessors listed in our Privacy Policy -- only as needed to provide, secure and support the service. You are responsible for having the right to upload them and for their accuracy. You can export or request deletion of your account data at any time.
Acceptable use
Don’t use the platform to submit fraudulent shipment data, to attempt to circumvent another workspace’s data isolation, to abuse the API or rate limits, or to scrape or overload the public tools (HS code finder, duty calculator). We may suspend an account that does.
Third-party services
If you connect QuickBooks, NetSuite, an email mailbox or a webhook endpoint, data moves to or from that service at your direction, and that service’s own terms apply to it. Signing in with Google is also subject to Google’s terms.
Suspension and termination
You can stop using the platform at any time and request deletion of your account. We may suspend or close an account that breaches these Terms, doesn’t pay, or puts the platform or other customers at risk; where practical, we’ll tell you why first.
Liability
To the maximum extent permitted by law, our total liability arising out of or relating to these Terms or your use of the platform is limited to the total fees you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential damages, including fines or losses arising from an inaccurate declaration -- reviewing and approving every declaration before filing remains your responsibility, as set out above. The platform is provided “as is” without warranties of any kind.
Governing law and disputes
These Terms are governed by the laws of Ghana. Any dispute arising out of or relating to these Terms or the platform is subject to the exclusive jurisdiction of the courts of Ghana.
Changes to these Terms
We reserve the right to revise these Terms as the platform, our pricing or the law evolves. When we do:
- The revised Terms are published on this page with a new “Last updated” date.
- For material changes, we give workspace admins reasonable advance notice by email or in the dashboard before the changes take effect. Changes required by law, or needed to deal with a security or abuse issue, may take effect immediately.
- If you keep using the platform after a change takes effect, you accept the revised Terms. If you don’t agree, stop using the platform before that date and contact support@customsdeclare.com to close your account. We may also ask you to accept the revised Terms before you continue using your account.
